Bloomingdale Erb’s Palsy Lawyers

Attorneys for Birth Injuries in DuPage County

Erb’s palsy is the most common type of brachial plexus injury, affecting the upper brachial plexus, which controls the muscles in the shoulder and elbow. Injuries to the nerves that control these muscles can lead to full or partial paralysis in the arms and shoulders. Erb’s palsy is most often the result of shoulder dystocia during childbirth. Though there are times when this condition is unavoidable, it is most often preventable. If you have a child who has been diagnosed with Erb’s palsy, it is important to speak with a skilled birth injury attorney so you understand your rights and options.

For over 40 years, Mevorah & Giglio Law Offices has successfully represented families with children suffering from Erb’s palsy in the Chicago area and throughout Illinois. Major Causes of Erb’s Palsy

Erb’s palsy is almost always a result of shoulder dystocia during childbirth. Shoulder dystocia occurs in situations where the shoulders of the fetus are too large to pass through the birth canal. This causes the shoulders to become stuck behind the pubic bone, which can lead to permanent damage to the upper plexus nerves. When the fetus has difficulty passing through the birth canal, doctors sometimes make the situation worse by using unsafe methods to force the delivery.

Erb’s palsy can usually be prevented if doctors properly identify certain risk factors that make expectant mothers more susceptible to shoulder dystocia. These include:

  • Gestational diabetes during pregnancy;
  • Previous history of difficult pregnancies;
  • Previous history of large babies;
  • Abnormal size/shape of pelvis (particularly mothers with small pelvises);
  • Excessive weight gain by the expectant mother during pregnancy; and
  • Late delivery after a child's due date.

When these risks are identified ahead of time, measures can be taken to ensure a safe and healthy delivery. Failure to identify such risks and take appropriate measures may constitute negligence on the part of the medical professional.
